SoCA Equipment Loan Agreement

    DISCLAIMER
    The Borrower accepts all responsibility for operating the School of Creative Arts (SoCA) Equipment at their sole risk. The Borrower agrees to be responsible for the Equipment and that the Equipment will be returned to the University of the Fraser Valley (UFV) complete, undamaged and in proper working condition.

    COMPLIANCE WITH LAWS
    The Borrower shall comply with all applicable laws, ordinances, and regulations, if any, applicable to the transportation and use of the Equipment. The Borrower shall secure all applicable licenses or permits required to use the Equipment.

    INDEMNIFICATION
    In consideration for the Equipment loan, the Borrower agrees to indemnify, defend and hold UFV harmless from any and all damages, losses, claims, causes of actions, expenses and liability of any nature whatsoever associated with its use of the Equipment.

    USE OF EQUIPMENT
    The Borrower agrees to use the Equipment only in the manner to which the Equipment was designed and in accordance with the instructions accompanying the Equipment and/or by the instructions given by SoCA staff and instructors. The Borrower further agrees to use the equipment for academic, research, government or non-profit use only, and not for any commercial or personal use or application. The Borrower may not loan the equipment to third parties.

    ELIGIBILITY
    All borrowers must have a valid UFV student or employee card.
    All borrowers must be enrolled in, or have previously completed, all prerequisite UFV courses.

    LOAN PERIOD
    The equipment loan period is a maximum of 96 hours.
    Equipment can be picked up after 12 noon on the start date and must be returned by 12 noon on the due date.
    Equipment that is not picked up by 4 pm on the start date may be cancelled and reassigned to other borrowers.
    Failure to return equipment on time may result in a warning.

    RESERVATIONS
    All reservations for equipment must be done in person.
    Reservations are made only on a first come, first served basis.
    Equipment may be reserved in advance for a maximum of three 96 hour periods at a time and may not be booked consecutively.

    LOSS OF BORROWING PRIVILEDGES
    The Director of the School of Creative Arts at UFV may withhold borrowing privileges to the borrower at any time if the borrower has overdue equipment out, outstanding fines, three overdue equipment returns in an academic year, has not signed the policy agreement, is not authorized by their program for a particular piece of equipment, or displays significant disregard for SoCA Equipment Loan Agreement terms and conditions.

    DAMAGE TO EQUIPMENT
    In the event of damage or malfunction caused to the equipment as a result of accidents, neglect or use in a manner other than what the equipment was designed for, a fee may be applied Borrower’s UFV student account equivalent to the repair cost of the damaged Equipment.

    FAILURE TO RETURN EQUIPMENT
    The Borrower understands that failure to return the borrowed equipment by the due date and time may result in a fee applied Borrower’s UFV student or employee account equivalent to the replacement value of the unreturned equipment. UFV reserves the right to repossess any or all borrowed Equipment at any time.

    I understand that the School of Creative Arts Equipment Loan Agreement is a binding contract. By signing this Agreement, I fully understand, and agree to, the terms and conditions stated herein.
